- Estate Planning and Administration - Our attorneys have many years of experience in planning our clients' estates, drafting wills and powers of attorney, establishing trusts, probating estates and establishing guardianships. Estate Planning deals primarily with the distribution of an individual's property at his or her death, taking into account wills, taxes, insurance, property, and trusts so as to gain maximum benefit of all laws and, at the same time, carry out the person's wishes with a minimum of death tax liability. But Estate Planning also involves the appointment of others to make financial and health care decisions for a person when he or she is no longer able to do so. Probate is the court proceeding before the Clerk of Superior Court through which a will is proved to be valid and the estate of a decedent is administered. The process, generally, includes collecting a decedent's assets, liquidating liabilities, paying necessary taxes and other liabilities, and distribution of property to heirs. The Clerk's office also oversees the administration of guardianships that are sometimes required to be established for the protection of minors and persons with diminished capacity.
- Real Estate - Our firm represents both commercial clients and individuals in all proceedings and transactions that deal with real property - land and the structures attached to it - including purchase and sale, financing, mortgages, deeds of trust, liens and foreclosures, leases, zoning, title examinations, quiet title actions, closings, like-kind exchanges (simultaneous, deferred and reverse), eminent domain proceedings, and condemnation proceedings.
